(RepublicanJournal.org) – The US Supreme Court dealt Democrats a hard blow on March 4, when the justices unanimously decided that the state of Colorado had no right to boot former President Donald Trump from its primary ballot. But Maryland Rep. Jamie Raskin (D) isn’t ready to give up in the effort to disqualify Trump. He and his fellow Democrats are trying one final move in response to the landmark ruling.
The US Supreme Court decided against the Colorado Supreme Court’s December 2023 decision, which had determined former Trump indeed disqualified himself from the ballot by inciting the January 6 Capitol riot. The state justices had ruled that the former president’s actions made him ineligible for future office under the 14th Amendment. The latest decision found that the courts are powerless to dictate who can and cannot appear on the state’s ballots. It added that Congress is the only entity that can make such a determination.
Daily Caller reports that Raskin and his fellow liberal congressional colleagues are running with the ruling, noting that they might use the MAGA leader’s 2021 impeachment against him in their case. The Maryland representative recently spoke with CNN’s Dana Bash during a broadcast of “Inside Politics,” stating that he disagreed with the US Supreme Court’s interpretation of the law. He added that if the high court wanted to leave it up to Congress, then members would pursue it.
Newsweek reports that Raskin, along with Rep. Wasserman Schultz (D-FL), introduced HR7906 in 2022, allowing for civil action against anyone found to have committed insurrection and barring the individual from holding public office. The bill has been sitting with a subcommittee since November 2022.
The bill’s backers may reintroduce the measure to bring the issue back to the forefront. Special Counsel Jack Smith’s indictment against the former president includes charges related to the January 6 event, but it doesn’t specifically accuse Trump of committing insurrection, so Democrats likely have a difficult road ahead of them if they want to prove their case.
Raskin also expressed doubts as to whether Speaker Mike Johnson would actually allow him to bring the legislation to the House floor.
